Filing a complaint with us

If you have a complaint about our services or a product, it should be submitted in writing by email to complaints@obsiido.com or by mail to the below address:

Obsiido has appointed its Chief Compliance Officer as the Complaints Officer. All complaints will be received by the Complaints Officer, who will engage other members of the Obsiido Team accordingly.

When filing a complaint, tell us what went wrong, when it happened, and what you expect (for example, money back, an apology, account correction).

To help us resolve your complaint sooner make your complaint as soon as possible, reply promptly if we ask you for more information, and keep copies of all relevant documents, such as letters, e-mails, and notes of conversations with us.

We will acknowledge your complaint in writing, as soon as possible, typically within 5 business days of receiving your complaint. We may ask you to provide clarification or more information to help us resolve your complaint.

We will provide our decision normally within 90 days of receiving a complaint. It will include a summary of the complaint, the results of our investigation, our decision to make an offer to resolve the complaint or deny it, and an explanation of our decision. If our decision is delayed and we cannot provide you with our decision within 90 days, we will inform you of the delay, explain why our decision is delayed, and give you a new date for our decision.

If you are not satisfied with our decision, you may be eligible for Ombudsman for Banking Services and Investments (OBSI) dispute resolution service.

Filing a complaint with OBSI

You have the right to use OBSI’s service if your complaint relates to a trading or advising activity of our firm or by one of our representatives; you brought your complaint to us within 6 years from the time that you first knew, or ought to have known, about the event that caused the complaint; and you file your complaint with OBSI according to the time limits below.

If your complaint relates to your accounts with Obsiido, then you may be eligible for the free and independent dispute resolution service provided by OBSI if (i) we do not provide our decision within 90 days after you made your complaint, or (ii) you are not satisfied with our decision. OBSI can recommend compensation of up to $350,000.

Escalating to OBSI does not restrict your ability to take a complaint to a dispute resolution service of your choosing at your own expense, or to bring an action in court. Keep in mind there are time limits for taking legal action.

Time limits apply. If we do not provide you with our decision within 90 days, you can take your complaint to OBSI any time after the 90 day period has ended. If you are not satisfied with our decision, you have up to 180 days after we provide you with our decision to take your complaint to OBSI.

OBSI can help you best if you promptly provide all relevant information, including your name and contact information, our firm’s name and contact information, the names and contact information of any of our representatives who have been involved in your complaint, details of your complaint, and all relevant documents, including any correspondence and notes of discussions with us.

OBSI will investigate. OBSI works confidentially and in an informal manner. It is not like going to court, and you do not need a lawyer. During its investigation, OBSI may interview you and representatives of our firm. We are required to cooperate in OBSI’s investigations.

OBSI will provide its recommendations to you and us once it has completed its investigation. OBSI’s recommendations are not binding on you or us. OBSI can recommend compensation of up to $350,000. If your claim is higher, you will have to agree to that limit on any compensation you seek through OBSI. If you want to recover more than $350,000, you may want to consider another option, such as legal action, to resolve your complaint.

Investments in the Obsiido Portfolios

Prospective Canadian Investors

SECURITY

Obsiido has taken many measures to secure your personal information and maintain its confidentiality.

Information not Confidential

Unfortunately, the electronic transmission of information is not completely secure, and Obsiido cannot guarantee the complete confidentiality or security of any information that you provide electronically (including via email or through the Site). You acknowledge that Obsiido is not responsible for any damages or losses you may suffer as a result of your electronic transmission of confidential or sensitive information, and you do so at your own risk. Time Outs

For security reasons, where you have logged into your account with Obsiido and there is no activity for a certain time period, your session will be terminated automatically, and you will be required to log in to your account again to re-gain access.

Protect your Account

If you open an account with Obsiido, you are solely responsible for maintaining the security and confidentiality of your login and password and your mobile device, and for ensuring that others do not use them without your permission. You agree not to disclose your password to any person and to keep it secure. You further agree that you are responsible for all instructions entered through and under your login, password, and account numbers, and any instructions received by Obsiido. All instructions shall be deemed to be made at the time received by Obsiido, and in the form received.

You agree to notify Obsiido immediately if you suspect your account may be compromised. Obsiido is not liable if you lose your credentials or if your account is compromised through your credentials.

To help protect yourself from fraud and/or viruses, you are also encouraged to do the following:

  • Install and update anti-virus software and a firewall on your computer;
  • Use a secure internet connection (avoid using public computers and public internet connections);
  • Frequently review your transaction history on your account; and
  • Protect yourself from phishing scams.

USES OF THE SITE

Permitted Uses

We grant you a limited licence to display and access the Site (and its content) for non-commercial, personal, or educational purposes only. No other use is permitted. Without limiting the generality of the foregoing, you may not:

  • access or use the Site in any way or for any purpose that is prohibited by applicable law;
  • make any commercial use of the Site;
  • include Site content in or with any product that you create or distribute; or
  • copy Site content onto your or any other website.

Where you provide a link to the Site from another website, Obsiido may require you to disable such link.

Notwithstanding the above, nothing contained in this licence shall be construed as conferring any right under any copyright of ours or any other person who owns the copyright in Content provided on the Site.

Prohibited Activities

The framing, mirroring, scraping or data-mining of the Site or its content in any form and by any method is strictly prohibited.

Decompiling, disassembling, reverse engineering, attempting to reconstruct or discover any intellectual property or confidential information of Obsiido, including, without limitation, source codes, ideas, and algorithms of Obsiido’s underlying technology by any means whatsoever or other exploitation of the Site, its architecture or the underlying software or code is strictly prohibited.

You are also prohibited from attempting to interfere with the functionality of the Site, including by introducing any viruses, attempting to breach Obsiido’s security measures, disrupting services to other users, and using any automatic devices to monitor or copy any of the Site content.

LIABILITY AND INDEMNITY

No Warranties

Obsiido does not warrant the quality, accuracy or completeness of any information on the Site or that the Site will operate without interruption. The Site is provided on an “as is” and “as available” basis, without any representations, warranties or conditions of any kind, whether expressed or implied, and including, without limitation, implied representations, warranties or conditions of title, non-infringement, merchantability, fitness for a particular purpose, performance, durability, availability, timeliness,

accuracy, or completeness, all of which are hereby disclaimed by Obsiido to the fullest extent permitted by law. The Site may include inaccuracies or typographical errors. In no event shall we be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available on the Site.

Limitation of Liability

In no event will Obsiido or any of its personnel be liable, whether based on warranty, contract, tort, negligence, strict liability or any other legal theory, for any damages of any kind, including, without limitation, direct, indirect, incidental, consequential, special, exemplary, punitive damages, lost profits, loss of use, loss of data, personal injury, fines, fees, penalties or other liabilities, whether or not Obsiido or any of its personnel is advised of the possibility of such damages, resulting from the use of, or the inability to make use of, the Site or the content.

Indemnity

By accessing the Site, you agree to indemnify and hold harmless Obsiido and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your breach of these Terms or your use of the Site.

INTELLECTUAL PROPERTY

The Site, its design and all content belongs to Obsiido and is protected by copyright owned by, or licensed to, us. The use, publication, or redistribution (whether uploading or downloading) of any trademarks, logos, or other content displayed on, or any information on the Site without our consent is prohibited and may violate our legal rights.

References to “OBSIIDO” and the Content provided on the Site are protected by trademark and copyright law, as applicable.

OBSIIDO and its logos, slogans, taglines and other trademarks are trademarks of Obsiido Capital Management Ltd., used under licence, and may not be used without permission.

Nothing in this section grants you any right or licence from us, or any other person who owns the content on our website. You can display on your computer, print, download, and use the underlying HTML, text, images, audio or video clips, software and other content on our website only as needed to evaluate whether to invest in a particular product or service or request a particular service. However, you (a) must not modify the content, and (b) must show it comes from our website together with any associated copyright notice. No other use is permitted.

GENERAL LEGAL PROVISIONS

Severability

If any provision of the Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of the Terms and shall not affect the validity and enforceability of any remaining provisions.

Governing Law

The Terms are governed by the laws of Ontario and the laws of Canada applicable therein, excluding any conflict of laws which would lead to the application of any other laws. By accessing the Site, you hereby irrevocably submit and attorn to the provincial and federal courts located in the City of Toronto, Ontario for any disputes or matters arising from, connected with, or relating to the Site, this agreement or any related matters.

We are committed to protecting your personal information. This Privacy Policy aims to help you understand our personal information collection, use, disclosure, and retention practices.

By providing personal information to us directly or on Obsiido.com and any of its associate websites, including Obsiido Direct, (the “Site”), you agree and authorize us and our third-party service providers (which may be located or process information outside of Canada) to process your personal information for the purposes set out below. We have adopted privacy practices in accordance with applicable Canadian federal and provincial privacy legislation.

We may change our Privacy Policy and Cookies Policy from time to time in the future. We encourage you to review the current versions whenever you visit the Site to stay informed of how we are processing personal information. This Privacy Policy does not apply to, and we are not responsible for, any third-party websites which may be accessible through links from the Site. What is personal information?

Personal information refers to information that identifies you, your spouse, or your beneficiary as an individual. It may include, but is not limited to, information such as your age, marital status, employment history, social insurance number, home address, personal e-mail address, and telephone number.

What personal information do we collect and how do we collect it?

We generally collect your personal information directly from you. This includes personal information that you share with us when you do any of the following:

  • open an account via Obsiido Direct;
  • subscribe for units of an investment fund managed by Obsiido, such as the Obsiido Portfolios;
  • contact us;
  • provide your email address to opt-in for more information from us; or
  • visit the Site. We use cookies to collect information about your visit to the Site. Please see our Cookie Policy, which forms part of this Privacy Policy, for more information about our use of cookies.

In most cases, explicit consent will be obtained from you to allow us to collect, use, process and disclose your personal information. In some cases, and were permitted by law, we will imply consent based on your actions.

We may monitor and record our conversations with you. You will be provided with a notice at the beginning of any call that is being recorded.

We may also obtain personal information from other sources, including, but not limited to, financial institutions or service providers. For example, if you open an account through Obsiido Direct, we will obtain personal information from Persona, a third-party service provider engaged to verify your identity. This information will be obtained with your consent. Also, if you open an account on Obsiido Direct and decide to automatically link your bank account using Flinks, a third-party service provider, you consent to us obtaining your bank account information from your financial institution.

We do not knowingly collect information from children or other persons who are under 18 years old. If you believe we may have information from a child, please contact us.

We will also collect information from the devices you use to access the Site.

How do we use your personal information?

We value your personal information and will ensure the appropriate safeguards are in place to maintain confidentiality and security. We use your personal information to make recommendations for our products or services, provide the services that you requested, communicate with you regarding the services you requested, and improve our services to you. Your personal information allows us to better understand your needs and preferences and allows us to provide you with tailored advice and investment solutions. In addition, your personal information allows us to do the following:

  • understand and assess your eligibility for our products and services;
  • provide you with the services you have agreed to obtain from us;
  • protect you and us from error and fraud; and
  • comply with applicable laws.

If you open an account on Obsiido Direct, your personal information will also allow us to establish and verify your identity and transfer funds between your bank account and Obsiido account.

Under some circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

Who do we disclose your personal information to?

We will not disclose your personal information without your consent except as set out in this Privacy Policy. We use your personal information only for the stated purposes and do not share it with any third-parties except in specific cases where it is necessary to meet our service requirements or to comply with applicable laws, as set out below:

  • third-party service providers and/or partners who provide (i) website, application development, hosting, maintenance, and other services to us; (ii) fund administration, recordkeeping, custody, and other services to us for clients with accounts on Obsiido Direct and investors in investment funds managed by Obsiido, including the Obsiido Portfolios; and (ii) identity verification, banking information, and anti-money laundering and anti-terrorist financing checks. These third-parties may have access to, or process, personal information as part of providing services to you or us. We require these service providers to use your personal information only as necessary to perform the services we have hired them to provide and will ensure appropriate controls and protections are in place to protect your personal information. Most of our service providers process personal information in Canada or the United States. In the event personal information is transferred outside of Canada, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with the laws of those jurisdictions. Where applicable, we will take steps to require that such parties treat your personal information in accordance with this Privacy Policy and use and disclose it only for the purposes for which it was collected. If you have any questions about our use of service providers, please contact us.
  • parties connected with the proposed or actual financing, insuring, sale or other disposal of all or part of our business or assets for purposes connected to evaluating and performing the transaction. These parties may have access to personal information for the purposes of determining whether to proceed with the transaction or business relationship, or as a result of us fulfilling any records or other reporting requirements to such parties. Where applicable, we will take steps to require that such parties treat your personal information in accordance with this Privacy Policy and use and disclose it only for the purposes for which it was collected.
  • law enforcement and governmental entities when required or authorized by law. For example, to meet our reporting obligations under tax and securities laws; where the rules of court require us to provide personal information to the opposite side and the court in a litigation matter or where a court issues a subpoena or order; or to cooperate with law enforcement or other governmental agencies.
  • other joint account holders. If you open a joint account on Obsiido Direct or invest in an investment fund managed by Obsiido through a joint account, personal information collected from any of you about your investments or for the purposes of opening and maintaining your joint account may be shared, solely with respect to the joint account, with the other joint account holders.

Where required or permitted by applicable laws, we may share your personal information for other reasons.

How long do we retain your personal information?

We will only keep personal information for as long as reasonably necessary to fulfil the relevant purposes set out in this Privacy Policy and in order to comply with our legal and regulatory obligations. In determining how long personal information will be retained, we will consider the following factors:

  • nature of the personal information;
  • purposes for which the personal information was collected;
  • legal or regulatory requirements that apply to the retention of the personal information;
  • our business needs and practices; and
  • any other relevant factors.

How do we protect your personal information?

We take the responsibility of securing your personal information seriously, and we will take appropriate measures in the circumstances to mitigate any identified risks to you. We follow industry best practices to protect the information submitted to us, both during transmission and once we receive it. We maintain physical, technical, and administrative safeguards to protect personal information in our custody and control against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal information in our possession.

Your access to personal information through Obsiido Direct is protected with multi-factor authentication. We strongly recommend that you do not disclose your password or share your mobile device with anyone. We will never ask for your password in any unsolicited communication (such as letters, phone calls or email messages).

We have taken steps to ensure that the only personnel, under a duty of confidentiality, who are granted access to your personal information are those with a business ‘need-to-know’ or whose duties reasonably require such information. These employees are required to use multi-factor authentication to access any such personal information. Our employees are responsible for ensuring the confidentiality of all personal information they may access. Each employee annually signs off on our Privacy Policy and completes mandatory privacy training to ensure they understand their obligations and expectations as it relates to the activities they perform.

Data is encrypted both at rest and in transit. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Although we do our best to protect your personal information, we cannot ensure or warrant the security of any information you transmit or provide to us, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards. If you believe your personal information has been compromised, please contact us.

What are your rights and choices with respect to your personal information?

Accuracy of personal information: We keep the personal information that we collect as accurate, complete, and up to date as appropriate. You may request, in writing, that any incomplete or inaccurate personal information we hold be corrected. Your personal information must be accurate, complete, and up to date if you have an account on Obsiido Direct.

Access to personal information: You may request access to your personal information. Subject to applicable law, you may be able to receive a copy of the personal information we hold. Requests for access by to your personal information must be in writing and must provide sufficient detail so as to enable a proper and efficient response. We will provide appropriate access to personal information that is properly requested. A written explanation will be provided if the requested access is not granted. Access requests should be made, in writing, to the Privacy Officer.

Withdraw consent: If you have opted-in to receive information from us but do not have an account via Obsiido Direct, you may unsubscribe, if you do not wish to receive any further updates from us. You are unable to unsubscribe from notices that pertain to your account with Obsiido Direct.

In addition, under certain circumstances, you may withdraw your consent at any time to the collection, disclosure, or use of the personal information. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. Further, withdrawal of your consent may make you ineligible for our products or services. Any withdrawal of consent would not apply to personal information that we are required to retain under applicable laws.

Complaints: We are committed to treating you with respect and consideration in all dealings, including matters of privacy. However, we understand that misunderstandings or errors may occur. In such circumstances, you may file a privacy complaint with us by contacting our Privacy Officer. We will act promptly and diligently to resolve the issue.

Complaints?

You have the right to file a complaint with the applicable Privacy Commissioner about our collection and processing of your personal information.
